So, Do you think this letter will work?

Dear Sir,

Supply of Goods & Services Act 1982 (As amended)

On 28 Nov 2008, you undertook repairs to my car, Toyota Avensis, reg *******, to replace a perished crank pulley. (Copy of bill included here.)

On or around 14th Dec 2008, you undertook the same repair again at no charge as the symptoms had returned.

As the symptoms then returned once more, I took the car to a garage local to my workplace for an opinion as to whether a lasting solution would be cost effective on a car of that age.

After 3 hours labour in removing the crank pulley which had become fused to the crankshaft, it became clear that a bolt of the wrong length with the wrong thread (photo included) had been used in your original repair.

As the car could not then be re-assembled to a road-worthy state, repairs were undertaken in Aylesbury to a total cost of £455.17. (Copy of bill included.)

A phone call to Consumer Direct (part of the Office of Fair Trading) pointed me to the Supply of Goods and Services Act 1982 (as amended). This states that work should be carried out with reasonable care and skill, using parts that are fit for their intended purpose.

As you were in breach of this act, I would like you to reimburse me for the cost of repairs incurred as a result of your use of the wrong bolt, which is £455.17.

Please reply in the next 14 days. If you fail to reply in this time, I will have no option but to consider taking the matter further.

Yours,

**********************

You may think me strange, but as I was reading this letter Jamie is sending, I kept thinking, 'Only 3 hours' labour? That's nothing! I was in labour with Jack for 3 days.' (In a blizzard.)
Now see, THIS is the kind of mind I have.

I think I'm trying not to focus on the £455.17 we may have lost due to a mechanic's incompetence.

Bravo! Concise and professional and your request is reasonable. Hopefully, they will see it that way and refund your money.

I had a similar problem with our Honda van that was rear-ended in Illinois. When we went through a hurricane in Virginia, water leaked all through the back. I sent a similar letter to the collision center in Illinois and they promptly refunded the money I'd had to pay in Virginia for a repair shop to fix the repairs that hadn't been done properly the first time.

It's a good letter, Dorothy. What a sickening situation to be in.

What a terrible thing to have happen.. glad you were finally able to get it fixed properly and hoping it doesn't take too long to get reimbursed as you should

What a great letter! I hope all goes well for you. I just found your blog via Chez Nous. It's lovely. My husband and I are a Christian couple in the WAY north of Scotland... the land of the heathens! (Well, it seems that way more often than not, anyway.) Your blog was really inspiring, and we were just talking about a Jesse Tree for next year. I am going to get the Holiday Planner for help with that. What a find! Thanks for sharing. :-) Stacey

I cracked up at your comment, because it was something that I would think! lol I can imagine how much fun having a cup of tea with you would be. :)

Great letter. I pray that you have a quick and easy resolution. It's so sad when shops quit doing good, reliable work.

Great letter! Either your hubby has a legal background or he is a natural. I hope it works. We have small claims court here in the U.S.; I imagine you have something similar if you need to take it to the next level. You certainly put them on notice if they fail to respond, and have your ducks in a row. What an annoyance though. Prays for a good resolution :)

Thanks, guys. We really need that mney back, so please pray that the garage does the right thing straight away.

Yes, small claims court would be the next stage. We've never taken anyone to court before and the whole process is very scary. Where is Judge Judy when you need her? LOL!

Yep, just think if you were paid hard cash for your labor!

AWESOME letter. Let us know if you get your $$ back. Did you pay by VISA? Here if you pay by VISA and you're unhappy with the service they will go to bat for you!
